An independent contractor is a person or business engaged to perform specific work but who is not an employee. Unlike employees, independent contractors control how their work is done and are responsible for their own tax and employment obligations.
In law, this distinction is crucial because employers are generally not vicariously liable for the torts of independent contractors. However, exceptions exist where the work is inherently dangerous, involves statutory duties, or is closely controlled by the party engaging the contractor.
