KembaraXtra – Legal Terms – Peaceful Enjoyment of Possessions

Peaceful enjoyment of possessions is a right protected under Article 1 of the First Protocol to the European Convention on Human Rights.

The right protects individuals against unjustified interference with their property by public authorities.

Interference with possessions must be lawful, pursue a legitimate aim, and remain proportionate.

Public authorities that deprive individuals of property will usually be expected to provide compensation.

The right became enforceable in UK law through the Human Rights Act 1998.
