A regulated agreement is a consumer-credit agreement or consumer-hire agreement that falls within the scope of the Consumer Credit Act 1974. These agreements are subject to statutory controls designed to protect consumers when borrowing money or hiring goods. The Act establishes rules concerning the formation, enforcement, and administration of such agreements. Lenders and creditors must comply with these legal requirements. Failure to do so may affect the enforceability of the agreement.


The purpose of regulating these agreements is to ensure fairness and transparency in consumer transactions. Consumers are often in a weaker bargaining position than lenders and may lack specialist financial knowledge. The legislation therefore requires important information to be disclosed before the agreement is entered into. This allows borrowers to make informed decisions. Consumer protection is a central objective of the regulatory framework.


Not every credit agreement is regulated by the Act. Certain categories are specifically exempted from regulation. Examples include some debtor-creditor-supplier agreements secured by land mortgages and certain mortgage-related arrangements involving local authorities or building societies. Parliament has determined that these agreements should be governed by other regulatory mechanisms. As a result, they fall outside the ordinary scope of the Act.


The Consumer Credit Act also grants powers to exempt additional categories of agreements. The Secretary of State may exempt agreements where the number of repayments does not exceed a specified limit. Agreements connected with foreign jurisdictions may also be excluded. These exemptions recognize that not all transactions require the same level of regulation. The law therefore balances consumer protection with commercial practicality.


Regulated agreements remain a fundamental aspect of consumer finance law. They provide legal safeguards for borrowers and hirers while imposing duties on creditors. The framework promotes responsible lending practices and transparency in financial transactions. It also helps maintain confidence in the credit market. Regulation therefore serves both consumer and economic interests.
