A Section 47 enquiry is an investigation carried out by a local authority under section 47 of the Children Act 1989 to determine whether action is needed to safeguard and promote the welfare of a child. The local authority has a statutory duty to conduct such enquiries where there is reasonable cause to suspect that a child is suffering, or is likely to suffer, significant harm. The enquiry forms a central part of the child protection system. Its objective is to identify risks and determine appropriate intervention. Child safety remains the overriding priority.

A Section 47 enquiry may also be required where a child is subject to an emergency protection order or is in police protection. Social workers investigate the child’s circumstances by gathering information from parents, schools, healthcare providers, police, and other relevant agencies. They assess the child’s physical, emotional, educational, and developmental needs. The enquiry aims to establish whether significant harm exists or is likely to occur. Multi-agency cooperation is often essential.

After completing the enquiry, the local authority decides what action, if any, should follow. It may conclude that no further intervention is required or that support services should be provided to assist the family. Alternatively, it may apply for a care order, supervision order, child assessment order, or emergency protection order. Each decision depends upon the level of risk identified during the investigation. Judicial authorization is required for many protective measures.

Where access to the child is denied during the enquiry, the local authority is expected to seek an emergency protection order from the court. This ensures that concerns regarding the child’s welfare can still be investigated despite parental obstruction. The law therefore prevents child protection investigations from being frustrated where serious risks are suspected. Judicial oversight protects both the child and the rights of family members. The statutory process balances protection with procedural fairness.

Section 47 enquiries represent one of the most important mechanisms within child protection law. They ensure that allegations of significant harm receive prompt and structured investigation by qualified professionals.
