The Sentencing Code is a comprehensive consolidation of sentencing procedure in England and Wales contained in the Sentencing Act 2020. It came into force on 1 December 2020 and applies to all convictions occurring on or after that date, regardless of when the offence was committed. The Code brings together numerous sentencing provisions previously scattered across different statutes. Its principal purpose is to simplify and clarify sentencing law. It does not introduce substantive changes to sentencing policy.

The Code governs sentencing procedures for both adults and young offenders. It sets out the general principles applicable to sentencing, the available types of criminal sentences, and the procedures courts must follow when imposing them. It also regulates various ancillary orders that may accompany a sentence, such as behaviour orders and other preventive measures. This unified approach assists judges, lawyers, and court officials. It promotes greater consistency across criminal courts.

The Sentencing Code is a consolidating statute. This means that it reorganizes and restates existing legal rules without substantially altering their legal effect. Parliament deliberately avoided making major policy changes during consolidation. Instead, the objective was to improve accessibility and reduce complexity within sentencing legislation. Future reforms are intended to be implemented by amending the Code rather than creating additional fragmented legislation.

Although comprehensive, the Code does not encompass every aspect of sentencing law. Certain matters remain governed by separate legislation, including confiscation of criminal assets and sentencing provisions contained within the Road Traffic Acts. Courts must therefore continue to consult other statutes where relevant. Nevertheless, the Code provides the primary framework for most criminal sentencing decisions. It greatly simplifies legal research and judicial practice.

The Sentencing Code represents one of the most significant modern reforms of criminal procedure in England and Wales. By consolidating numerous statutory provisions into a single legislative framework, it improves legal certainty and efficiency. Judges can more easily identify the applicable sentencing rules, reducing the likelihood of procedural error. Legal practitioners also benefit from a more coherent body of legislation. Ultimately, the Code strengthens the administration of criminal justice.
