Land Law – Mortgage - Protection under consumer protection legislation
In cases when a notable disparity in rights exists between the mortgagee and mortgagor, the latter may also have recourse to consumer protection laws. Since solicitors are typically not regulated to provide financial advice, consumer protection legislation does not significantly affect the legal advice you can provide to a client. However, it is important to note this here so that you are aware of it and how the mortgagor should be given enough information to ensure they are fully aware of the risks associated with mortgage conditions. The existing laws can be divided into the following categories:
The Consumer Rights Act of 2015 will regulate generic abusive phrases. The Financial Service and Markets Act of 2000 mandates that lenders offering regulated mortgage contracts make sure the agreements are clear and equitable, and it is applicable to mortgages made after October 31, 2004. Failure to comply may give rise to a claim for damages from the mortgagor.
If the court determines that the connection between the mortgagor and the mortgagee is unjust to the mortgagor, they may step in under the Consumer Credit Act of 2006.
