Legal Terms - Ad Litem
Ad litem is a Latin term that means "as regards the action". A grant ad litem is the court's appointment of an individual to represent an estate in legal proceedings.
Proceedings occur in situations where the designated representatives of an estate are incapable or unwilling to fulfill their duties. For instance, the Official Solicitor can be designated as an administrator ad litem in cases where an individual wants to make a claim against an estate under the Inheritance (Provision for Family and Dependants) Act 1975, but the personal representatives are unwilling to take action, or there is no one eligible to receive a grant, or the only person eligible to receive a grant is the litigant themselves. After the completion of the relevant actions, the estate's authorized agents can apply for a general grant, which will result in the termination of the temporary grant. A guardian ad litem, previously known as a litigation friend, is an individual who is entrusted with the responsibility of representing and managing legal proceedings on behalf of another person, usually a juvenile.
