Legal Terms - Age Discrimination
The legislation pertaining to age discrimination was enacted in 2006 and is currently codified in the Equality Act 2010. Age
Employment discrimination and discrimination in the supply of products, facilities, and services have been illegal since April 2012. The scope of this policy includes both explicit and implicit forms of discrimination, as well as instances of victimization and harassment. However, age discrimination is distinct from other "protected characteristics" because it might be genuinely justified, such as when rejecting an application for an HGV license. There are other additional cases when the main guidelines will not be applicable, such as age-based discounts and government assistance.
Unfair dismissal and redundancy claims no longer have age restrictions. Employers cannot impose mandatory retirement ages or force employees to retire, unless they can prove that it is a reasonable way to achieve a valid objective (Seldon v Clarkson Wright and Jakes [2012] UKSC 16, [2012] ICR 716).
