Legal Terms - Anti - Avoidance Provisions
Provisions aimed at preventing the act of avoiding something, particularly in a legal or financial context.
A collection of legal regulations created to prevent specific arrangements that might otherwise decrease the taxpayer's obligation to pay taxes. The primary provisions aimed at preventing tax avoidance pertain to the following areas: 1. Deep discounted securities, as specified in section 427 of the Income Tax (Trading and Other Income) Act 2005. 2. Manufactured dividends, covered by sections 780-804 of the Corporation Taxes Act 2010. 3. Transactions in securities, governed by sections 731-751 of the Corporation Taxes Act 2010. 4. The sale of future income to a company in exchange for a capital sum, outlined in sections 752-757 of the Corporation Tax Act 2010.
Since 2013, a statute has been implemented that includes a General Anti-Abuse Rule designed to eliminate any tax benefit resulting from "abusive action."
