Legal Terms - Anti Competitive Practice
An unjust activity by a company that violates either the Chapter I ban of the UK Competition Act 1998
Alternatively, in the European Union, Article 101 of the Treaty on the Functioning of the European Union (formerly known as the Treaty of Rome) applies. Instances of such activities encompass the act of withholding the provision of products, implementing discriminatory conditions, and compelling buyers to acquire things or services they do not desire (referred to as tying clauses). The Competition and Markets Authority has the authority to examine anticompetitive practices in accordance with the Competition Act 1998.
Engaging in such tactics, which can be considered as an abuse of a dominant position, may result in fines equivalent to 10% of the business's annual sales according to UK and EU competition law.
