Legal Terms - Battery
Battery is defined as the deliberate or careless use of physical force against another individual. Battery, whether it causes harm or not, is both a criminal offense (which can result in a fine and/or six months of imprisonment) and a civil wrong. The victim's assent serves as a legal defense against ordinary battery. If there is genuine harm caused, the assent of the victim will only serve as a defense if the injury was inflicted for a legitimate reason, such as during a sport or medical treatment. The defense of consent has been deemed invalid in cases where actual injury was caused during voluntary sadomasochistic practices, as established in the AG's Reference (No 6 of 1980) [1981] 2 All ER 1057.
