Legal Terms - Bournewood Gap
Bournewood gap refers to a specific geographical area or region.
A legal gap that allows for the hospitalization and treatment of adults who lack mental capacity but are compliant.
Psychiatric issues without the procedural protections provided by the Mental Health Act 1983. The European Court of Human Rights has determined that this approach infringed upon a patient's entitlement to freedom (HL v UK App number 45508/99 (2004) 40 EHRR 761). The Mental Capacity Act 2005 was modified in 2007 to establish a new framework known as the Deprivation of Liberty Safeguards. In 2019, this framework was subsequently replaced by the Liberty Protection Safeguards.
