Legal Terms – Calderbank Letter
Calderbank letter, also known as a Calderbank offer, refers to a legal document that is used to make a settlement offer in a legal dispute. A letter previously used in a legal action, where one side offers to settle the case on specific grounds other than seeking money or damages. The initial correspondence of this nature was dispatched in the legal matter known as Calderbank v Calderbank [1976] Fam 93 (CA). Since the implementation of the Civil Procedure Rules in 1999, Calderbank offers are commonly referred to as Part 36 offers. Nevertheless, the phrase continues to be utilized in family courts. Calderbank letters are only relevant when the issue of costs arises.
