Legal Terms - causing death by careless driving when under the influence of drink or drugs
Vehicular manslaughter refers to the act of causing the death of another person as a result of driving while impaired by alcohol or drugs, or driving above the legal limit. In relation to this offense, which was added to the Road Traffic Act 1988 (s 3A) by the Road Traffic Act 1991, the act of driving must be assessed as careless rather than dangerous. The maximum penalty for this offense is five years of jail and mandatory disqualification.
