Legal Terms -compellable witness
A witness who refuses to testify in court could be held in contempt of court and legally compelled to testify. Everyone who is qualified to testify is, in theory, compelable. The accused's spouse or civil partner is typically competent and compelable to testify on behalf of the defense in criminal proceedings. Nonetheless, the accused's spouse or civil partner is typically not required to testify as a witness for the prosecution.
