Legal Terms -consummation of a marriage
The “completion” of a marriage by an act of sexual intercourse. For these reasons, it is defined as the penis completely penetrating the vagina (ejaculation is not required). Even though a contraceptive sheath is used, a marriage can still be completed. *A marriage may be dissolved if one of the spouses is unable to consummate the union or refuses to do so without a valid reason. The spouse's refusal to have sexual relations may have a valid explanation if one of the partners declines to set up a second marriage ceremony (such as one in a church) in the absence of which he knows the other will not consent. Even though that partner is willing to have sex, in this instance, the partner who declined to set up the ceremony is considered to have not consummated the marriage. The legal notion of non-consummation of marriage does not apply to marriages between individuals of the same sex or to any pair forming a civil partnership.
