Legal Terms - credit for guilty plea
the sentence reduction that an offender is eligible for as a result of entering a guilty plea. The Criminal Justice Act of 2003, section 144, mandates that the sentencing court consider two factors for calculating the appropriate sentence: (i) the stage of the proceedings at which the criminal indicated his desire to plead guilty, and (ii) the circumstances surrounding the indication. When an offender changes his plea on the first day of trial, the credit provided can be as high as one-tenth of the appropriate sentence reduction. This credit can be earned by an offender who pleads guilty at the first reasonable chance. In the event that a guilty plea is entered during the trial, the reduction might be much lower—zero. There are distinct factors to take into account while sentencing murderers.
