Legal Terms - Criminal Injuries Compensation Scheme
A state program designed to compensate victims of *criminal injury with public monies in a manner similar to that of civil damages (see also COMPENSATION). Property damage is not covered under the plan. The program is run by a board that has the authority to (1) refuse or reduce an award if the claimant does not cooperate with the police in obtaining information about the circumstances surrounding the injury or in helping them apprehend the wrongdoer; or (2) because of the claimant's actions, unlawful behavior, or behavior related to the injury. Relatives of those who pass away following a criminal injury may also be eligible for compensation. The board may request a county court order compelling a convicted party to pay back the board in full or in part for an award that was made. With effect from April 1, 1996, the Criminal Injuries Compensation Act of 1995 established new guidelines for compensation. The scheme is presently (2021) being reviewed.
