Legal Terms - date of termination
effectiveness The date on which an employment contract terminates, specifically the expiration date of any notice provided, the conclusion of a fixed-term contract, or the date of the employee's dismissal or resignation in the absence of notice. An employee terminated without the requisite statutory minimum notice is regarded as having continued employment for that duration post-dismissal, which is pertinent for assessing eligibility to petition an employment tribunal regarding unfair dismissal, as well as for calculating his weekly remuneration and basic award (refer to compensation; continuous employment). The effective date of termination initiates the three-month period during which the terminated employee may file a claim with the employment tribunal.
