Legal Terms - default notice
a notification that must be given to a party who violates a contract before pursuing legal action against them. In accordance with the Consumer Credit Act of 1974, before a creditor or owner may terminate an agreement, demand early payment of any amount, reclaim possession of any goods or land, treat any rights granted to the debtor or hirer by the agreement as terminated, restricted, or deferred, or enforce any security, the creditor or owner must serve a default notice on the debtor or hirer in violation of a regulated agreement.
The type of breach, the necessary remedial action (if any), and the deadline for taking that action must all be included in the notice. The notice must state the amount (if any) that must be paid in compensation and the deadline for payment if there is no way to address the breach.
