Legal Terms - defence statement
a written declaration in criminal proceedings that briefly describes the accused's defense. The conditions outlined in the Criminal Procedure and Investigations Act of 1996 must be met by a defense statement. It should outline the accused's intended defenses, the factual points of contention with the prosecution, the rationale behind those contentions, and any legal positions he may want to take (including those pertaining to the admissibility of the evidence). Details about any *alibi, including information on any alibi witness, must be included in a defense statement. In the event that the accused presents a defense during the trial that differs from the one outlined in the defence statement, the jury or the court may make any reasonable deductions when determining whether the accused is guilty of the relevant offense. In cases before the Crown Court, after the prosecution has given preliminary disclosure, the accused is required to serve a defense statement. During the magistrates court hearings, the accused has the option to provide a defense statement.
