Legal Terms - distance selling
The transaction of goods or services to a consumer without physical interaction, including sales conducted via mail order, telephone, digital television, email, or the Internet. The EU Distance Selling Directive 97/7 provided significant consumer protections, which were enacted in the UK by the Consumer Protection (Distance Selling) Regulations 2000, and subsequently reinforced by the Consumer Rights Directive 2011/83, applied in the UK via the Consumer Contracts Regulations 2013. The Consumer Rights Act 2015 has further consolidated the legislation. Consumers possess rights to specific information regarding the contract to be executed and, in numerous instances, the right to rescind the contract within a designated timeframe, often 14 working days from the date of delivery. The right is applicable regardless of the items' condition, although it is not applicable in some significant circumstances. areas include auctions, betting, consumer-specific commodities, perishable food items, and digital downloads once the downloading process has commenced.
