A magistrate is appointed to this position as a result of their occupancy of another office, typically that of mayor of a city or borough. The Justices of the Peace Act 1968 and the Administration of Justice Act 1973 abolished the majority of ex officio magistrateships. However, the Lord Mayor and aldermen of the City of London are justices of the peace ex officio, while High Court judges are justices of the peace ex officio for the entirety of England and Wales.
