A false description of products produced in the course of a business (see trade description). The Trade Descriptions Acts 1968 and 1972 governed offenses committed prior to 26 May 2006. It was an offense to apply a false trade description to products either directly, by implication, or indirectly (e.g., by tampering with a car's mileometer or painting over rust on the bodywork). It was also illegal to supply or offer to supply products with a false trade description. These offenses were triable either summarily or on indictment, with a maximum prison sentence of two years. The Consumer Protection from Unfair Trading Regulations 2008, which are supplemented by the Business Protection from Misleading Marketing Regulations 2008, repealed this legislation.
