Article 8 of the European Convention on Human Rights and the Human Rights Act of 1998 ensure respect for family life. According to Marckx v Belgium (App no 6833/74) [1979] ECHR 2, the right to family life includes homosexual and gay couples (Oliari and others v Italy (App nos. 18766/11, 36030/11) ECtHR, 21 July 2015). This right is a *qualified right: the public interest can be used to justify interference with it, as defined by law. Article 12 of the Convention states that individuals have the freedom to marry and establish families.
