The violation of the Foreign Enlistment Act 1870 involves enlisting oneself or others, without the Crown's authorization, for military service with a foreign nation engaged in conflict with a state at peace with the UK. A foreign state, for this purpose, encompasses a portion of a province or individuals exercising or claiming governmental authority. Under the Act, it is also an offense, unless licensed, to construct or equip any vessel for such duty or to organize any naval or military expedition against a state with which the UK is at peace.
