Legal Terms – Freezing Injuction
An injunction allowing the court to freeze a defendant's assets, regardless of their residency within the jurisdiction of the English court, may be obtained pursuant to Part 25 of the *Civil Procedure Rules. The injunction prohibits the defendant from transferring his assets outside the court's jurisdiction, as well as from selling, managing, or devaluing his assets. The injunction is severe and so necessitates explicit justification. Any individual requesting a freezing injunction must give all pertinent information to the court. Prior to the implementation of the Civil Procedure Rules in 1999, freezing injunctions were referred to as Mareva injunctions, derived from the case Mareva Compania Naviera Se. v International Bulkcarriers SA [1980]
