Legal Terms – Hague Convention on the Civil Aspects of International Child Abduction
An international treaty designed to protect children from wrongful removal or retention across borders.
It requires that disputes be resolved in the country where the child is habitually resident and provides for the prompt return of abducted children.
If an application is made within 12 months of abduction, the court must order return unless certain exceptions apply — such as risk of physical or psychological harm, or if the child is mature enough to object to return.
