Legal Terms-Half-Secret Trust
Also known as a semi-secret trust, it is a trust declared in a will or legal document where the existence of the trust is disclosed but the beneficiaries remain undisclosed.
The trustee is informed privately of the trust’s terms before the testator’s death.
Example: A testator leaves property to B “to hold on trust according to terms already communicated to him.”
The leading case, Blackwell v Blackwell [1929] AC 318, confirms the validity of such trusts provided the terms were communicated before death
