Nickerson v. Harris (1873) CQB
The defendant lawfully advertised that on August 12, 13, and 14, 1872, in Bury St. Edmunds, there would be an auction of plant, office furniture, and brewing supplies. On August 12, the plaintiff arrived from London with a commission to buy office supplies. The defendant announced on August 14 that it would not be selling the office furniture. The plaintiff sought two days' worth of lost wages, a third-class train ticket, and two days' worth of board and lodging.
Held:
The plaintiff had no claim against the defendant since the advertisement was seen to be "a mere declaration of intention" by Archibald J. rather than a contractual offer.
